Court Rules
Arraignments
Dalton Municipal Court arraignments are held each week. Your court date and time is indicated on your citation or criminal appearance bond.
Court Clerk’s cannot reschedule your arraignment! However, the court does allow the clerk to set another appearance date if the defendant contacts the clerk’s office prior to their originally assigned arraignment date. In these instances the defendant will be addressing the court for the original violation(s) and their failure to appear as originally assigned.
Persons requesting to reschedule their arraignment are expected to produce to the court (Judge) at the time of their appearance documentation that gives a legal reason they were not able to attend the prior date.
Requesting a Trial
If you want to contest a citation, you must come to court on your court date and request a trial. Your trial will not be held on that date; instead, your trial will be scheduled by the court.
Requesting a Attorney
Right to Counsel
The Dalton Municipal Court may provide Indigent Defense access to individuals that qualify under Chapter 12 of Title 17. Each applicant is required to pay a $50.00 application fee.
If you do not qualify for indigent representation and desire to be represented by an attorney you will need to make arrangements to hire a lawyer prior to your court date.
Appeals
Appeals from the Dalton Municipal Court are made to the Whitfield County Superior Court
